Terms and conditions

Acceptance and modification

The Société de transport de Laval’s (hereinafter called “STL”) website and its mobile apps, its dynamic display devices and any other digital tools it might make available to the public (hereinafter collectively called “Tools”) provide general information as well as certain services, documents, information tools, forms and accounts pertaining to STL’s mission (hereinafter “Content”). 

Users who access or browse the Tools, download their Content in whole or in part or otherwise use the Tools and their Content agree to the terms and conditions of use described hereinafter and to STL’s Privacy Policy. Users may also be required to comply with additional terms and conditions associated with certain Tools or sections of the Tools (hereinafter collectively called “Terms”).

Please read the following carefully, as any user of these Tools is deemed to have read and accepted the Terms, acknowledged their validity and agreed to comply with and be bound by them.  

STL may amend the Terms at any time and without notice. The date of the most recent change to the Terms is indicated at the bottom of this document. In the event of such a change, users are thereupon bound by the Terms thus amended and agree to abide by them.

If users do not accept the Terms or any amendment thereto, if applicable, they must not use the Tools.

These Terms constitute all the rights and obligations binding STL and any user of the Tools. They replace any and all previous terms or provisions relating to the use of the Tools. No verbal or written declaration made by an employee or officer of STL or by any other person may have the effect of amending or replacing the Terms.

Applicable laws

The STL’s website and associated data are hosted on servers located in Canada (in the provinces of Quebec and Ontario).

The Content and use of the Tools are governed by the relevant statutes of Quebec and Canada. The Terms, as well as any dispute or disagreement arising from their enforcement, shall be interpreted in accordance with those statutes.

Should any part of these Terms be contrary to law, null or unenforceable, that part shall be deemed severable from the Terms and shall not compromise the validity and enforceability thereof, and the Terms shall thereupon be interpreted without making reference to the severed part. Any recourse, action, motion or legal proceedings based on the contents or use of the Tools and taken against STL or involving the latter, shall be brought before a court of Quebec.

Copyright

Unless otherwise indicated, STL owns all the Tools and their Content, whether in written, visual, audiovisual, binary, audio or other form. The Content is protected by Canadian and international copyright legislation (in particular, by the (Copyright Act, R.S.C. 1985, c. C-42). STL holds copyright over such aspects as the selection, coordination, arrangement and improvement of the Content.

It is illegal to reproduce, alter, download, publish, copy, post, display, share, index in a database or otherwise distribute all or part of the Content or capitalize on it, in particular, by participating in its sale or transfer or by creating works arising therefrom. Without limiting the generality of the foregoing, misappropriation of the Content via linking or framing is not permitted.

Notwithstanding the foregoing, the open-source data made available by STL via the Tools may be downloaded and capitalized on in strict compliance with the terms and Conditions of use inherent in their downloading. Additionally, STL nevertheless allows any user of the Tools to make a copy of their Content, subject to the restrictions on the use of official marks and other marks, without any specific authorization or charges, provided that: 

  • such copy results from one single download, on a single computer; 
  • such copy is made for strictly personal purposes and in no way for commercial or for-profit purposes; 
  • STL is clearly identified as the source of the copied documents; 
  • the copy is not presented as an official version of the copied documents nor as a copy made in cooperation with STL, under its supervision or with its consent; 
  • the contents of the copied documents are not modified with the purpose of or the result of infringing STL’s moral rights. 

STL grants no licenses other than the one stated above and, moreover, reserves all intellectual property rights over the Content of the Tools.

The users of the Tools agree to STL freely capitalizing on or using the ideas, concepts, knowhow or techniques communicated to it electronically or by telephone, regardless of the purpose, and they transfer to STL their potential rights in this respect, without STL being obliged to pay any royalties or making other payments whatsoever, but subject to STL’s commitment with regard to the protection of personal information.

Official mark and trademarks

The expression “STL” and the STL logo are official marks of a public authority within the meaning of sub-paragraph 9(1)(n)(iii) of the Trademarks Act (R.S.C. 1985, c. T-13), and are duly registered as such. 

Moreover, certain graphics, logos, icons, drawings, expressions, words or slogans present in the Tools constitute, or may constitute, official marks, trademarks, service marks, manufacturer’s marks or certification marks pursuant to the laws of Canada or to those of any other country. Those marks may be registered as such. The fact that such marks may be displayed in the Tools is not tantamount to granting or transferring any license whatsoever. 

STL reserves all rights with respect to any official mark, trademark, service mark, manufacturer’s mark or certification mark that it holds or uses. It is illegal to download, copy, post, display, share or otherwise distribute such a mark. STL will exercise all appropriate legal recourse against any person using a mark that STL holds or that it uses itself. 

Integrity and accuracy of information

STL endeavours to ensure that the information available in the Tools is complete, accurate and up to date. Such information comes from sources that STL considers to be reliable and is regularly updated. It may nevertheless contain inaccuracies, omissions and typographical errors or may otherwise be flawed. Consequently, the Tools and all of their Content are made available to the public “as is”, without any warranty of any nature, whether express or implied, including, without limitation, implied warranties of merchantability, non-infringement or fitness for a particular purpose.

When using the Tools, including the services, documents, information tools, forms, accounts, notices and real-time schedules offered therein, you agree to do so at your own risk. STL makes no representations and provides no warranties of any nature whatsoever concerning the tools, including the services, documents, information tools, forms, accounts, notices and real-time schedules found therein.

Without limiting the generality of the foregoing, STL provides no warranty with regard to the availability or stability of the Content of the Tools, the ability to access the Tools or the accuracy, reliability or completeness of the information provided, including, without limitation, information relating to schedules, STL partners, legislation or regulations, the availability of the transportation services described or public calls for tenders. Users are advised that the Tools are regularly subject to technical maintenance, which may limit or prevent access thereto. STL may, at its sole discretion, suspend, discontinue or restrict the use of any such Tool or any portion thereof, at any time, without notice or liability.

Neither STL, nor its officers, directors, employees, suppliers, contractors or agents, shall be held liable for any direct or indirect damages whatsoever arising out of or in connection with the use of the Tools or any functionalities of the Tools or of any site related or pertaining thereto, including, among others, special harm, damages related to a security incident, punitive, exemplary, incidental, moral or consequential damages, loss of profits, loss of revenue, loss or theft of information, damages for operating losses or loss or deletion of programs or data in an information system, or any other expenses or damages resulting from:

  • the use or unavailability of the Tools;  
  • the algorithms they contain;  
  • the incompatibility of any software downloaded or copied therefrom;  
  • an interruption;  
  • a defect;  
  • a delay in processing or transmission;  
  • the presence of a computer virus, malware or other destructive elements;  
  • a power failure or system outage, and all this whether or not STL is informed of the possibility of such damages, losses or expenses. 

Any person who uses the Tools does so at their own risk and thereby waives the right to bring any civil, criminal or quasi-criminal liability claims against the STL and its officers, directors, employees, suppliers, contractors or agents in connection with the use of the Tools, regardless of whether the aforementioned parties were negligent.

Unless otherwise indicated, any and all monetary amounts appearing in the Tools are expressed in Canadian dollars.

Rules for use of the Tools  

Users agree not to use the Tools: 

  • in an inappropriate manner, of any nature whatsoever;  
  • to attempt to interfere with the Content or access it by using a method other than the interface and the instructions made available to the user;  
  • to damage, overload or compromise the Tools or put them out of service;  
  • to disrupt the security of the Tools;  
  • to disturb or disrupt the use of the Tools by third parties; 
  • to attempt to obtain unauthorized access to the Tools or to certain portions of the Tools where access is limited;  
  • to download, display or otherwise transmit any virus or harmful, disruptive or destructive computer program.  

Without limiting the generality of the foregoing, STL does not authorize the users of the Tools to alter, rephrase, adapt, change, adjust, rearrange, disassemble, isolate or decode the Content, except to the extent permitted by the information personalization features specifically made available to users by STL.

Moreover, users are strictly prohibited from using the Tools to post or share any illegal material, threats, texts, sounds or images of a defamatory, obscene, fraudulent, scandalous, seditious, pornographic or blasphemous nature, or any other material that could constitute a criminal or penal offence or that could promote or encourage the commission of such an offence, give rise to a civil liability suit or otherwise violate appliable law.

Users agree that they are solely responsible for their use of the Tools or their Content and agree to comply with all applicable laws governing the use of the Tools. Without limiting the generality of the foregoing, the Content, the services and the functionalities of the Tools are also available on mobile devices. Users shall not use them in a manner that could distract the users and prevent them from complying with the Highway Safety Code or any other applicable laws. 

STL platforms 

Moreover, when using STL’s online platforms, such as STL email addresses and STL’s social media accounts, users are encouraged to read and comply with the STL Netiquette.  

Users also acknowledge that certain STL online platforms, such as STL’s social media pages (e.g., Facebook, X, LinkedIn, Instagram and YouTube), are owned by third parties. Where applicable, the “Third-Party Sites” section of the Terms applies to the use of such platforms.

Messages 

Users acknowledge that, in the context of their use of the services offered in the Tools, STL or its service providers, acting on its behalf, may send them messages relating to such use, in accordance with applicable law and STL’s Privacy Policy. Users may choose to stop receiving some of those messages, in accordance with applicable law.

Users acknowledge that certain services require STL to send messages. Should users no longer wish to receive such messages, they must stop using those services.

Accounts 

Users may need an account to use some of the servicers offered in the Tools. Users must create their own accounts. To protect their accounts, users must keep their passwords confidential. Users acknowledge that they are responsible for all activity associated with or conducted through their accounts. Users are encouraged not to reuse the passwords associated with their accounts for third-party sites. If users become aware that their passwords or accounts have been used without authorization, they are encouraged to change their passwords immediately or call the Customer Contact Centre at 450-688-6520 without delay.

At any time, users may delete their accounts themselves by accessing their customer portal and profile settings. Deleting an account in the customer portal does not delete the data appearing in the customer’s record with STL.

Whether obtained via the customer account, by telephone, through the online contact form, by email, in response to a survey, through participation in a contest, through consent to receive electronic communications or through social media messages, the information collected by STL is retained in accordance with applicable law. Customers who would like to have their records and personal information permanently deleted from STL’s records and systems must submit a request by calling 450-688-6520.

Third-party sites

The Tools contain hyperlinks that quickly provide access to websites owned and managed by third parties. STL makes such hyperlinks available to the users of the Tools solely as a convenience and exercises no form of control over the contents of the sites to which the hyperlinks lead. 

Moreover, STL makes no representations, endorses no content and assumes no responsibility for the content or use of such sites. Some of those sites may use persistent or temporary cookies. Please also note that information available on third-party sites may not be available in French and/or English. Users acknowledge that once they click on such a hyperlink or otherwise access a third-party site, the information exchanged is no longer subject to STL’s Privacy Policy. STL assumes no responsibility for the use of such sites, particularly with regard to their security standards and the accuracy of the information contained therein. 

Tool management and technical issues

The Tools are fully managed or administered by STL. We ask users to inform us of any technical issues or errors encountered during browsing by calling the Customer Contact Centre at 450-688-6520 or by using the form provided for this purpose in the Contact Us section of our website.

French language

This is a translated version of the original Conditions d’utilisation des outils numériques published in French. If there is any discrepancy between the French version and the English version of the Terms and Conditions, the French version shall prevail.

NOTICE REGARDING ENGLISH CONTENT

Under the Charter of the French Language (CQLR, c. C-11) and its regulations, STL is required to provide its services in French unless an exception authorizes service in another language. 

By accessing the English version of any content available through STL’s Digital Tools, you represent that you belong to one of the following groups eligible for such an exception: 

  • persons who corresponded exclusively in English with STL before May 13, 2021; 
  • persons declared eligible to receive instruction in English; 
  • Indigenous persons; or 
  • immigrants who have been in Quebec for less than six months.
